Military personnel CONUS and OCONUS are rapidly discovering there is a more viable alternative to settle divorce matters than hiring lawyers to file for divorce and paying high legal fees, court imposed rulings and experiencing the wide swing of frustrating emotions coming along with an individual’s right to file suit. This alternative is a civil process called “Divorce by Mediation” and is quickly earning a growing respect among couples faced with a tough decision to sue or sometimes “do nothing” in common cases of divorce and family issues and disputes. Service Members face at least the same, or in fact more complicated issues when dealing with divorce, since deployments and overseas assignments are part of the equation. Divorce by mediation is available to all service members by certified mediators in their state. Unfortunately, most service members are not aware of these services. Just as in a civilian divorce, a military divorce involves procedural requirements, property distribution, and perhaps child or maintenance support.
Divorce by mediation is the process where a trained certified neutral party known as "mediator", you and your spouse, participate in a series of private mediation sessions in a calm and productive atmosphere. Avoiding the courtroom battles between lawyers that usually characterize divorce litigation, you work together through mediation to achieve a reasonable settlement for the whole family. If there are children resulting from the marriage, their interests are carefully considered. No one is required to appear in court at any time during the mediation process unless otherwise directed by court order. A Marital Settlement Agreement is prepared, signed by a notary and can be filed as part of the Judgment, which for the most part resolves all the divorce issues.
If you or your spouse cannot attend in person, some of the mediation sessions can be conducted by telephone. This process is known as "telephonic appearance".
Jurisdiction. The service member often has a choice of which state to file in, commonly known as "forum shopping." Some states are more favorable to the military member and others, to the spouse.
